NHS Covid Pass becomes compulsory to attend nightclubs & large events in Wales

From 7am on 11 October 2021, it’s compulsory for anyone over the age of 18 to provide a Covid Pass, recent negative LFT or recent negative PCR test in the following circumstances in Wales:

Applicable Premises

Licensed premises and members clubs are applicable premises if they meet all the following three criteria:

  1. the premises is authorised to serve or supply alcohol;
  2. the premises is open late at night between the hours of midnight and 5am; and
  3. the premises provides music for dancing.

The premises must meet all three of the criteria to be captured by the requirement to operate a Covid Pass. However, the premises is captured by the requirement to operate the pass at all times, not just between midnight and 5am (if music is provided for dancing).

Events

Everyone attending certain events:

  • indoor non-seated events for more than 500 people, including concerts and conventions;
  • outdoor non-seated events for more than 4,000 people;
  • and any setting or event for more than 10,000 people, such as a sporting match.

These limits are applicable on the number of people attending not the capacity of the premises

Exemptions – Premises

  • nightclubs (or similar premises) but at the relevant time they aren’t providing music for guests to dance;
  • the event is outdoors, doesn’t need an entrance fee or ticket to attend and the premises has multiple entry points (for example, a free fireworks display or a farmers market);
  • premises being use for a protest or for picketing;
  • a mass participation sporting event outdoors (for example, marathon, cycle race, triathlon or iron man type events); or
  • premises being used for a marriage or civil partnership celebration or a wake (where such celebrations are permitted)

Exemptions – Individuals

  • persons under the age of 18; and
  • those working or volunteering at premises where a Covid Pass would be required.
