Mrs J was diagnosed with Alzheimer’s disease and lived in a care home in Morecambe from September 2005 until she died in August 2007. Due to her dementia, she was unable to communicate effectively, exhibited challenging behaviour and completely reliant on care staff to anticipate her daily care needs. In addition, Mrs J required comprehensive assistance in taking her medication and was at a high risk of falls and malnutrition.
Hugh James was instructed by Mrs J’s family. We appealed the retrospective review of Mrs J’s care needs and following a local resolution meeting, the Morecambe Bay Clinical Commissioning Group confirmed Mrs J was eligible for NHS Continuing Healthcare for the last 11 months of her life.
Mrs J’s family was reimbursed over £23,000 in care fees and interest.
