Hackney carriage and private hire driver licensing

We act on behalf of both taxi drivers and operators, as well as those making applications to their local licensing authority for their first Hackney Carriage and/or Private Hire Drivers or Vehicle licences.

Each licensing authority (usually the Local Authority in whose area you are driving or wish to drive) has its own rules in relation to the issuing, refusing, suspending or revoking licences. What they mostly have in common, however, is a procedure for determining whether you are a “fit and proper person” to hold the licences that you are applying for.


Licences

Applying for a licence

If you are considering making an application to your local licensing authority for a Hackney Carriage and/or Private Hire Driver’s licence, then we will be able to assist you with making that application. This is particularly important in cases where the local licensing authority may have concerns over medical fitness or if there are other relevant matters that might affect your fitness and propriety to hold the licences you are applying for.

As each local licensing authority tends to have different rules, we are able to formulate a set of submissions, based on your individual circumstances, with the aim of ensuring that your application is as comprehensive as possible, and directly addresses the matters that may give rise to concerns.

Investigations into existing licence holders

For existing licence holders facing investigation into their fitness and propriety to hold their licences, we understand that your licence is often your sole means of income and is therefore critical to your livelihood.

If you have been notified that a disciplinary hearing is to be convened by your local licensing authority, then it is vitally important that you are represented at such meetings, as the consequences can be far-reaching.

It is essential that your interests are protected at such meetings to ensure that the Committee determining the matter does not take into account irrelevant matters or place undue weight on extraneous or peripheral matters.

Suspended or revoked licences

If your local licensing authority has suspended or revoked your licence or has imposed conditions that are unreasonable, then you should seek advice as quickly as possible. There are very limited timescales within which appeals can be brought.

Likewise, if your local licensing authority has refused your application, then you should seek advice swiftly, as there are also limited timescales to appeal against the refusal to grant a Hackney Carriage or Private Hire Driver’s licence.

We can then provide advice and representation during the appeal process, to include:

  • Appeals to the Crown Court
  • Appeal by way of case stated
  • Judicial Review
