Acting mainly for brain injured clients, however injured, including workplace and road traffic accidents or criminal assault. Also acting for spinal cord injured clients or those that have suffered amputation or serious orthopaedic injuries and in fatal accidents.
Recent experience
Nicola acted for a young man who suffered a severe brain injury, significant loss of sight and pituitary gland damage when travelling as a passenger in his friends car. The case included arguments on contributory negligence for failure to wear a seatbelt and issues relating to capacity and reasonableness of accommodation. The case settled for £13.3 million on a lump sum basis.
Successful appeal of a First Tier Tribunal decision, where the Tribunal had determined that a young man would only require a Financial Deputy for a short period post accident to enable the Deputy to invest his CICA award, after which he would be able to deal with his day to day finances. There was no evidence before the Tribnual to say the capacity related only to investment or that capacity was likely to be regained. The award for the Deputyship element of the claim was increased from £25,812 to £233,965.
