Mr F J Clow was diagnosed with dementia and entered a care home in 2007 in Bletchley, Milton Keynes at the age of 86 and remained there until he sadly passed away in 2013.
As a result of his dementia, Mr Clow displayed challenging behaviour, experienced falls, and required full assistance with his personal care needs.
Hugh James requested a retrospective review, in 2012 of Mr Clow’s past care. Following a number of appeals through Arden and Greater East Midlands CSU and finally to a NHS Independent Review Panel, the NHS agreed Mr Clow was eligible for NHS Continuing Healthcare for the last 4 years of his life and his care fees should be refunded.
His family recovered over £129,500 in wrongly paid care fees and interest.
Mr Clow’s daughter stated:
The NHS process is onerous and difficult to navigate. It has taken 8 years and 8 months to claim the Care Home fees for my late father.
Throughout this time everyone I have dealt with at Hugh James has been friendly, patient, helpful (explaining medical and legal terms), encouraging and have always kept me up to date.
Without their support, professionalism and expertise I would never have been able to complete this journey.
