In this set of two podcasts, Roman Kubiak and Kieran Forsyth discuss the top 5 Crypto and Digital Asset litigation cases of 2022.
First up, they discuss Osbourne v. Persons Unknown and Others [2022] EWHC 1021 (Comm). A case where the High Court recognises NFTs as property which can be subject to freezing injunction.
Second, is the case of D’Aloia v. Persons Unknown [2022] EWHC 1723 which Roman and Kieran discussed last year in the first round of podcasts but it is deserving of a further brief mention given the novel way of effecting service.
Last up in this podcast is Jones v. Persons Unknown [2022] EWHC 2543 where the High Court recognised an existence of a constructive trust as between cryptocurrency platform and victim of crypto scam and which was influential in achieving a successful recovery of lost crypto.
