Case studies

Compensation secured and private medical treatment secured for mesothelioma sufferer

Adam* who was semi-retired when diagnosed with mesothelioma, formerly worked for an Essex foundry (dissolved) and several building firms in the 1970s as a labourer all of which were all dissolved. No Employer’s Liability insurance could be located and despite these difficulties, Phoebe Osborne repeated extended ELTO searches with different variations, several times before submitting a last resort Diffuse Mesothelioma Payment Scheme (DMPS) application, eventually she located a policy after extensive and repeated EL insurance searches. Thereafter she obtained a supportive witness statement from former colleagues to corroborate her client’s recollections of the foundry working conditions and asbestos lagged pipes. The claim settled January 2024 for a six figure sum plus funding for private medical treatment. Phoebe also recovered nursing fees for Mesothelioma UK within the claim.

Employment investigation leads to admission of liability and compensation for retired self-employed Cambridge carpenter

Benjamin*, was diagnosed with mesothelioma in his 80s. Historically he worked as a self-employed carpenter joiner after his apprenticeship and a brief period of PAYE work in the mid-1960s. Due to the passage of time, he was a poor historian and could not recall the dates or locations of the many contracts he was involved in which complicated the insurance position, liability was denied by one identified past employer Rattee & Kett Limited but there was no proof of his employment (his HMRC stated No Employers Recorded). Phoebe Osborne attended Cambridge archives in Ely to review historic purchase ledger books for this prestigious local building firm and found manuscript reference to Benjamin* and a co-worker of his which corroborated those jobs he mentioned from the 1960s and most important provided the precise timeline needed for verifying the insurance position. Phoebe also located reference to payments made to Turners Asbestos and other jobs the client was involved in which he had forgotten, strengthening our allegations. The claim settled December 2023 for a substantial sum, plus future medical treatment Order. Phoebe also recovered nursing fees for Mesothelioma UK within the claim for the support provided by the national charity nurse at Royal Papworth Hospital.

Significant settlement secured for mesothelioma sufferer following asbestos exposure during university holiday

Colin’s* mesothelioma exposure involved him removing asbestos lagging from pipework in Whitehall London for Simmons & Hawker during a brief summer job he did at university for about a month. Prior to his mesothelioma diagnosis he managed his extensive land and garden in rural Norfolk where he had retired. Given the value of the claim, the claim for services could not be resolved pre issue or in his lifetime. Our requests for a Joint Settlement Meeting were ignored by the insurers. The claim was issued in the Royal Courts of Justice and the claim settled six weeks before Assessment of Damages hearing for over £100,000 more than the defendants counter schedule of loss. The claim settled in December 2023 and included recovery of hospice fees for Norfolk Tapping House Hospice who provided end of life care to the deceased

Compensation and admission of liability secured for client with mesothelioma

Daniel* was diagnosed with sarcomatoid mesothelioma in his early 60s and underwent immunotherapy under the NHS. Phoebe Osborne secured an admission of liability and a substantial interim payment during this gentleman’s lifetime against his former employer Howard Rotavator Ltd for his past asbestos exposure relating to him replacing brake linings and clutches on heavy machinery using an airline. The case settled on a fatal basis for a seven figure sum, plus recovery of local hospice fees for St Elizabeth Hospice. The claim settled in December 2023.
